Right of withdrawal

Consumers have a right of withdrawal, whereby a consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed to their commercial or independent professional activity. If an entrepreneur purchases for his private consumption, he is also considered a consumer:

Right of withdrawal

You have the right to cancel the purchase contract concluded with us within thirty days of receipt of the goods, even without giving reasons.

The cancellation period is thirty days from the day on which you or a third party named by you who is not the carrier of the goods notifies HOMESTORYS GmbH by means of a clear, written statement (e.g. a letter sent by post or an email). inform you about your decision to withdraw from this contract.

You can use the attached sample cancellation form, although this is not mandatory. Returning the goods without comment is not sufficient for a cancellation to be effective.

The cancellation period is met if you send the notification of your exercise of the right of cancellation before the cancellation period has expired.

Attention: The right of withdrawal exists unless the parties have agreed otherwise.

The right of withdrawal does not exist:

  • in the case of distance selling contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer
  • for contracts for the delivery of sealed goods that are not suitable for return for health or hygiene reasons if their seal has been removed after delivery.

    Consequences of revocation

    If you cancel the purchase contract concluded with us, we will return to you all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the one offered by us, have chosen the cheapest standard delivery), to be repaid immediately and at the latest within thirty days from the day on which we received notification of your cancellation of this contract or the goods covered by the contract.

    For the repayment, we will use the same payment method that you used for the original transaction, unless something else was expressly agreed with you in writing. In no case will you be charged any fees for this repayment.

    You must return or hand over the goods to us immediately and in any case no later than thirty days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the deadline of thirty days after receipt has expired.

    We can refuse repayment until we have received the contractual goods back undamaged or until you have provided evidence that you have sent the goods back, whichever is earlier.

    Important information for your cancellation and possible return

    So that we can process your revocation, please notify us by email or letter. You can also use the attached cancellation form.

    After receiving your cancellation, you will receive a message from us with which reference the goods must be returned so that we can process and process your cancellation quickly.

    If you would like to have the delivered goods picked up by a shipping company, please pack the goods back in the original box and, in the case of large furniture, place them back on the pallet on which they were delivered. If you cannot be present during collection and leave the goods outside for collection, please remember that it could rain and protect them against moisture if necessary.

    You bear the direct costs of returning the goods. The return costs include both the costs for the return transport and the costs for the proper packaging of the goods.

    If the goods are picked up by a shipping company, you can expect to pay between 50 and 200 euros per large piece of furniture, depending on the volume and where you live. A large piece of furniture corresponds to the packing unit of one pallet (e.g. a bed with two bedside tables is considered a large piece of furniture if it fits on a pallet).

    You only have to pay for any loss in value of the returned goods if this loss in value is due to you handling them in a way that is not necessary or appropriate to check the nature, properties and functionality of the goods.

    Special case premium delivery with assembly

    If you have opted for premium delivery with assembly or can use this service free of charge due to the distance to Eupen (up to 150 km radius), you have the following options:

    • You like the furniture and you waive your right of withdrawal. The technicians will then take the packaging away for disposal free of charge.
    • You don't like the furniture. The fitters will then take the furniture and packaging away and you will only have to pay the calculated costs for the premium delivery, but not the dismantling and return transport.
    • Even after assembly, you are still not sure whether you want to keep the furniture or exercise your right of withdrawal. In this case, it is advisable to keep the packaging material and pallet so that the return transport can take place in the original packaging. If the goods just have to be picked up, you can expect to pay between 9.5 and 250 euros per item, depending on the volume and where you live. If you want to have the furniture dismantled and picked up by the premium service, the costs you will have to pay are 1 euro per kilometer of journey from you to Eupen/Belgium plus VAT - regardless of the number of pieces of furniture.
